Terms & Conditions

Agreement

This Hire Agreement shall be between the Hirer and the Property Owner.

Payment

For bookings made within 8 weeks of your holiday start date, please pay the full amount plus damage deposit. For a booking made more than 8 weeks before your holiday start date, please provide a deposit of 25% of the rental cost or £100 (whichever is the greater). The balance plus the damage deposit is then due 8 weeks prior to the holiday start date. The booking form plus deposit must be received by us within 3 days of the booking form being sent out.

How to pay

Payment preferably by direct bank transfer please, although cheques and credit cards are also accepted. Please send the booking form and all correspondence to C. Thomas, 18 Gyllyngvase Terrace, Falmouth, TR11 4DL.

Balance Payment

Upon payment of the deposit and subject to acceptance of the booking, the applicant becomes liable for the balance of the rent 8 weeks before the holiday start date. It is your responsibility to make sure we receive the balance payment by the due date. We aim to send out reminders a few days beforehand but can’t guarantee this. Late balance payment may result in your holiday being cancelled and the forfeiture of your deposit.

What is included in the tariff

The rental cost is inclusive of all linen and towels, gas, electricity and Wi-Fi.

Booking conditions

The property may not be occupied by persons other than those named on the booking form. The hirer shall not part with possession of the property or share it except with members of the party named on the booking form. Should the booking conditions not be met the tenant agrees to pay any additional charges incurred and the owners of the property reserve the right to terminate the hire of the property immediately and without compensation.
We do not accept bookings for single sex groups of more than two persons.
The person booking holiday must be at least 23 years of age.

Availability

This Contract is made on the understanding that the property will be available for the dates stated. In the unlikely event that the property is not available through events arising out of the control of the Property Owner, the Property Owner may be forced to cancel the booking. The Hirer will be advised of such circumstances as early as possible and the Property Owner will refund all monies paid in full but the Hirer will have no further claims against the Property Owner.

Neighbours

The Hirer and other members of the party must not cause an annoyance or become a nuisance to occupants of the neighbouring properties.

Occupation Times

Tenancies commence after 4pm on the start date of your holiday and terminate at 10am on the finish date of your holiday. Under no circumstances may the Hirer enter the property or use the parking spaces before 4pm on the commencement date and the property and parking spaces must be vacated by 10am on the termination date.

Damage Deposit

All bookings are accepted on the condition that the property is left clean and tidy and all breakages or any damage will be paid for by the person who made the booking. The damage deposit less the cost of any damages will be returned to you within 2 weeks of your departure or we will notify you of any underpayment to be met. It is normally returned sooner than this but please allow 2 weeks.

Access

The Property Owner or their representatives shall be allowed access to the property at any reasonable time during the holiday occupancy.

Pets

Pets are allowed in Figgy Cottage subject to agreement and at a cost of £15 per dog per week. One small to medium sized dog is allowed in Terrazzo, again subject to the signing of a doggy contract.

Smoking

The property (consisting of Terrazzo and Figgy Cottage) is strictly non-smoking. If there is a smell of smoke on changeover this may result in an excess cleaning and rental charge. If it is impossible to let the property to the next tenants we will charge the full amount of their rental fee.

Personal belongings

Baggage and personal belongings are at the Hirer’s risk and no responsibility can be accepted for loss of or damage to such items.

Unnecessary call out charge

Should you make any unnecessary call out to the Property Manager or any other party then a call-out charge of £25 may apply.

Cancellation

Cancellations must first be advised by telephone followed by written confirmation within 7 days. The deposit is non-refundable in the event of cancellation. We will use our best endeavour to secure another booking on the property for the same term and if possible for the same charge but reserve the right to negotiate a charge. We shall not be liable at the suit of any hirer of accommodation on the grounds that we have not used our best endeavour or for any other reason.

For this reason we urge you to take out holiday insurance.

Should the unit not be re-let the hirer remains liable for the full hire charge 8 weeks before the start date of the holiday.
